1. Eligibility: The Ultimate Spy Family Weekend Sweepstakes (the "Game") is open only to legal residents of the forty eight (48) continental United States and the District of Columbia who are at least eighteen (18) years old at the time of entry. The Game is void where prohibited, restricted or subject to registration or bond. Employees, officers and representatives of House on F Street, LLC and Spy Gear® and Wild Planet Entertainment, Inc., as well as their immediate family (spouse, parents, siblings and children) and household members, subsidiaries, divisions, Board of Directors, participating sponsors and vendors, judges, advertising and promotion agencies and related entities (collectively, “Sweepstakes Entities”), and prior year grand prize and runner-up winners are not eligible. The Game is subject to all applicable federal, state and local laws and regulations. Participation in the Game constitutes the entrant's full and unconditional agreement to these Rules and the Sponsor's decisions, which are final and binding in all matters related to the Game. Winning a prize is contingent upon fulfilling all requirements set forth in these Rules.
2. Sponsors: House on F Street, LLC d/b/a International Spy Museum and Spy Gear® and Wild Planet Entertainment, Inc.
3. Timing: The Game begins at 12:00 AM Eastern Time ("ET"), on August 1, 2011. The Game may be discontinued at any time after September 30, 2011 at the sole discretion of the Sponsors.
4. How to Enter: During the Promotion Period, visit http://wildplanet.spymuseum.org fill out the online entry form completely, and submit the form. All potential winners are subject to verification before any prize(s) can be awarded. Administrator is responsible for the functionality of the Game.
5. Limit and Validity of Entries: Each participant may play one (1) time during the Promotion Period. Multiple participants are not permitted to share the same email address. Any attempt by any participant to enter more than once by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that participant's plays and that participant may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification. Sponsors are not responsible for lost, late, incomplete, invalid, unintelligible or misdirected registrations, which will be disqualified. In the event of a dispute as to any registration or play, the authorized account holder of the email address used to register will be deemed to be the registrant or player. The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider, Internet service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Potential winners may be required to show proof of being the authorized account holder.
6. Registration Information: Participants must register online to participate in the Promotion. When registering, Participants will be automatically opted-in to receive future emails from the Spy Museum but will have the option to opt-out upon receipt of emails, and entry information will be shared with Wild Planet®.
7. ALL POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION BY SPONSORS, WHOSE DECISIONS ARE FINAL AND BINDING. AN ENTRANT IS NOT A WINNER OF ANY PRIZE, UNLESS AND UNTIL ENTRANT'S ELIGIBILITY HAS BEEN VERIFIED AND ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE AND THAT THEY ARE THE WINNER.
8. Verification of Potential Winners: All selected potential winners must comply with all terms and conditions of these Rules, and all winnings are contingent upon fulfilling all requirements. At the end of the promotion, three (3) winners will be randomly selected (a main winner and two (2) runner-up winners), from a list of online entries received during the promotion period. The randomly selected entrants will be notified by e-mail as potential winners. Potential Game winners must continue to comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. The Potential Game Winners (or parent/legal guardian if winner is a minor in his/her state of residence) will be required to sign and return to Sponsor, within seven (7) days of the date notice or attempted notice is sent, an affidavit of eligibility to confirm they can meet all conditions, requirements, and dates outlined in the Contest Rules, liability/publicity release in order to claim his/her prize and fulfill any such other requirements as determined by Sponsor. If any Potential Game Winner cannot be contacted, fails to sign and return the affidavit of eligibility and/or liability/publicity release (when applicable) within the required time period, or if prize is returned as undeliverable potential winner forfeits prize and in Sponsor’s sole discretion, an alternate winner may be selected if: (i) any prize or prize notification is returned as undeliverable (ii) the potential Grand Prize Winner declines his/her prize (iii) the potential Grand Prize Winner is unable to travel on dates approved by the sponsor (iv) the potential Grand Prize Winner fails to comply with any of the Official Rules as outlined herein. Such potential Grand Prize Winner will be disqualified and an alternate winner may be selected by random drawing in the Sponsor’s sole discretion. Winners will receive their prizes approximately 6 – 8 weeks after the selection. In the event that a potential winner of any prize is disqualified for any reason, Sponsors will award the applicable prize to an alternate winner by random drawing from among all remaining eligible Game entries. All entrants will automatically qualify for the Grand Prize. The Grand Prize winner will be randomly selected from all eligible Game entrants between August 1, 2011 and September 30, 2011. The Grand Prize and Runner-Up Prize Winners shall be subject to the same requirements.
9. Grand Prize: One (1) Grand Prize Winner to be announced at the end of the Game period, will receive a three (3) day/two (2) night Ultimate Spy Family Weekend for four (4) people (two (2) Adults and two (2) Children ages 9 – 14. *Note – Winner must include at least (1) Adult and (1) Child between the ages of 9 - 14), at an approximate retail value (“ARV”) of up to Five Thousand Dollars ($5,000). The Ultimate Spy Family Weekend™ will consist of (a) one (1) airfare gift card from a major US Airline with total not to exceed value of $1400 for travel from the Winner’s residence to an airport in the Washington, DC area; (b) accommodations (one (1) standard room, four (4) person maximum occupancy) at a Washington, DC tourist-class hotel for two (2) nights; (c) round-trip tourist-class limo transportation between the hotel and the arrival airport in Washington, DC; (d) , local transport for four (4) via Open Top Sight Seeing Bus in Washington, DC for one (1) day; (e) One (1) family-style dinner for four (4) at Potenza Restaurant; (f) One (1) lunch for four (4) in Spy City Café; (g) Meet & Greet with Spy Museum Executive Director for family of four (4); (h) Overnight Kid’s Program at Spy Museum for two (2) kids ages 9 – 14 (must be accompanied by Adult or Guardian); (i) Admission passes for one (1) family of four (4) to International Spy Museum, Operation Spy®, and Spy in the City®; and (j) one (1) Spy Gear® Gift Pack from Spy Gear® and Wild Planet Entertainment, Inc. Actual value of the Grand Prize may vary based on point of departure and airfare fluctuations. The Grand Prize Winner is responsible for all costs and expenses not expressly provided for above, including, without limitation, additional ground and air transportation, additional meals, incidentals, tips, telephone calls, souvenirs, obtaining documents necessary for travel, other personal expenses and hotel charges incurred during the travel weekend. All travel arrangements including but not limited to Hotel Booking and Airline Gift Card will be made by the Sponsors at a hotel and with an airline of Sponsor’s choice, and travel weekend must be booked on dates and times selected by Sponsor in its sole discretion. Dates are subject to availability and must coincide with pre-determined dates of KidSpy® Overnight Program in November 2011 and other travel restrictions may apply. Travel weekend must be taken November 18 – 20, 2011. No extensions will be given after November 20, 2011, and the prize will be forfeited and Sponsors shall have no further obligations to the Grand Prize Winner. Sponsors are not responsible for any travel-related delays or cancellations. TOTAL ARV OF THE GRAND PRIZE: Five Thousand Dollars ($5,000). No substitution or transfer of the prize or cash redemptions will be permitted by the Grand Prize Winner. Sponsor reserves the right to substitute for any reason whatsoever a prize (or portion thereof) of comparable or greater value, in its sole discretion. Prize is awarded “as is” with no warranty or guarantee, either express or implied by Sponsor. The Grand Prize Winner is responsible for the reporting and payment of all taxes (federal, state and local), and fees associated with prize receipt and/or use as well as any other costs and expenses associated with acceptance and use of a prize not specified herein as being awarded. All prize details are in Sponsor’s sole discretion. Odds of winning the Grand Prize and any runner-up prizes depend on the number of eligible plays/entries received during the Promotion Period and number of prizes available (1) Grand Prize and two (2) Runner-up prizes.
10. Runner-up Prizes: Two (2) Runner-up Prizes will be announced after the Grand Prize is awarded, qualified and accepted at the end of the Game period. Each Runner-up Prize Winner will receive a Spy Gear® and Wild Planet Entertainment, Inc. gift pack. No cash or other substitution, assignment or transfer of any prizes will be permitted, except by Sponsors, who reserve the right to substitute a prize or prize component with cash or another prize of equal or greater value.
11. Rules and Regulations: Grand Prize Winner and Family must be legal U.S. residents, and, minors under the age of 18 must be accompanied by a parent or legal guardian. The Grand Prize Winner and Family Members will each be required to execute an affidavit of eligibility, liability release, tax acknowledgment form and except where prohibited by law, a publicity release (collectively, “Winner Documents”) and return them within three (3) business days of issuance of notification. Non-compliance within this time period or failure of the potential Grand Prize Winner to respond to a notification attempt within (48) forty-eight hours of such attempt may result in disqualification and, in Sponsor’s sole discretion; an alternate winner may be selected.
12. Publicity: Except where prohibited, participation in the Game constitutes winner's consent to Sponsors use of winner's and winner’s family names, likeness, photographs, voice, opinions, biographical information, hometown and state for promotional purposes in any media, including on the Sponsors web site or other medium without further payment or consideration, now or hereafter known, throughout the world in perpetuity.
13. General Conditions: Sponsors reserve the right to cancel or modify the Game if fraud, technical failures or any other factor beyond Sponsor's reasonable control impairs the integrity of the Game, as determined by Sponsors in their sole discretion. In such event, Sponsors reserve the right to award the prizes at random from among the eligible entries received up to the time of the impairment. Sponsors reserve the right in their sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Game or to be acting in violation of these Official Rules, or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately damage any web site or undermine the legitimate operation of the Game is a violation of criminal and civil law, and, should such an attempt be made, Sponsors reserve the right to seek damages from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
14. Release: By entering The Ultimate Spy Family Weekend Sweepstakes, entrants agree to release and hold harmless House on F Street, LLC d/b/a International Spy Museum, Spy Gear® and Wild Planet Entertainment, Inc. and any promotional partners, each of their parents, subsidiaries, affiliate and related companies, and each of its’ and their respective officers, directors, employees, and agents (collectively the "Released Parties") from and against any losses, damages, rights, claim or cause of action of any kind, regardless of cause, arising in whole or in part, out of participation in the Game or resulting directly or indirectly, from acceptance, possession, use, or misuse of any prizes awarded in connection with the Game, including without limitation personal injury, disability, death, and/or property damage, as well as claims based on travel activity and/or publicity rights, defamation, and/or invasion of privacy.
15. Limitations of Liability: The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Game; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Game; (4) technical or human error which may occur in the administration of the Game or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Game or receipt or use of any prize or while traveling to or from Washington, DC and/or any prize-related activity. If for any reason an entrant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant's sole remedy is another entry in the Game; provided that if it is not possible to award another entry due to discontinuance of the Game for any reason, Sponsor, at its discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. No more than the stated number of prizes will be awarded. In event that production, technical, seeding, programming or any other reasons cause more than stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsors reserve the right to award only the stated number of prizes by a random drawing among all legitimate, un-awarded, eligible prize claims.
16. Disputes: Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Game, or any prizes awarded, other than the administration of the Game or the determination of winners, shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court of the District of Columbia or the Superior Court of the District of Columbia; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Game but in no event attorneys' fees; and (iii) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Rules, or the rights and obligations of the entrant and Sponsor in connection with the Game, shall be governed by, and construed in accordance with, the laws of the District of Columbia, without giving effect to any choice of law or conflict of law rules (whether of the District of Columbia or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the District of Columbia.
17. Entrant's Personal Information: Information collected from entrants is subject to the Spy Museum Privacy Policy and Wild Planet Privacy Policy
18. Winner List For Grand and Runner-up Prizes: Game results of the Grand Prize and any Runner-up prizes and/or a copy of these Official Rules may be obtained by sending a self-addressed, stamped envelope to: The Ultimate Spy Family Weekend Sweepstakes, Official Rules/Winners, 800 F St., N.W. – 4th Floor, Washington, DC 20004. Requests must be received by October 14, 2011 for the winner list. Vermont residents may omit return postage for the official rules.
